These Terms of Service ("Terms") govern your access to and use of the Fautor platform at fautor.li (the "Platform"), operated by Davida Online, a company registered in Liechtenstein ("Fautor," "we," "us," or "our").
By creating an account or using the Platform, you agree to be bound by these Terms. If you do not agree, do not use the Platform.
These Terms apply to all users, including visitors, supporters ("Fautoren"), and athletes.
You must be at least 18 years old to use the Platform. By creating an account, you confirm that you meet this age requirement. We record a timestamp of your age confirmation for compliance purposes.
The Platform is designed for individual athletes in niche and self-funded sports. The following are not eligible for Athlete accounts: teams, clubs, and associations.
To use certain features, you must create an account by providing a valid email address and a password. You are responsible for:
We reserve the right to suspend or terminate accounts that violate these Terms or that we reasonably believe are being used fraudulently.
Athletes must apply via the Platform's application form. Applications are reviewed by our team as promptly as possible. We reserve the right to accept or reject any application at our sole discretion, without obligation to provide a reason.
Accepted Athletes agree to publish a minimum of 3 posts per calendar month. Posts may include text, images, or video. Athletes who consistently fail to meet this minimum may receive a warning and, if the pattern continues, may have their profile suspended.
Athletes set their own support tiers (2–5 tiers) with fixed monthly prices in EUR. Athletes may update tier names and prices at any time. Price changes apply to new subscriptions only; existing subscribers remain at their original price until they cancel and re-subscribe.

When a Fautor subscribes to an Athlete's tier, they authorise a recurring monthly payment at the tier's listed price. Payments are processed by Stripe Inc. on the same calendar day each month (or the nearest available day).
All tier prices are displayed and charged in EUR. CHF and USD are supported where available through Stripe. Currency conversion fees, if any, are determined by your card issuer or bank, not by Fautor.
Fautor retains a 10% platform fee from each subscription payment. The remaining 90% is paid out to the Athlete. The platform fee is deducted automatically at the time of payment processing.
If a recurring payment fails, your subscription status changes to "past due." Stripe will retry the payment according to its standard retry schedule. If the payment cannot be collected after retries, the subscription will be cancelled automatically.
Subscription payments are generally non-refundable. Because subscriptions grant immediate access to tier-gated content, refunds are not issued for partial months or for content already accessed. Exceptions may be made at our sole discretion in cases of demonstrable billing errors or platform malfunction. To request an exception, contact support@fautor.li.
Fautoren may cancel a subscription at any time from their account settings. Upon cancellation:
Athletes who wish to deactivate their profile should contact support@fautor.li. Active subscriptions will be cancelled and subscribers will be notified. Pending payouts will be processed before the profile is removed.
Payouts to Athletes are processed bi-weekly (every two weeks) via Stripe Connect. There is no minimum payout threshold. Athletes must complete Stripe Connect onboarding, including identity verification (KYC/AML), before payouts can be initiated.
Payout amounts equal 90% of subscription payments collected during the payout period (after the 10% platform fee). Fautor is not responsible for delays caused by Stripe, your bank, or incomplete identity verification.
Athletes are solely responsible for reporting and paying any taxes on income received through the Platform.
Athletes retain full ownership of the content they publish on the Platform. By publishing content, Athletes grant Fautor a non-exclusive, worldwide, royalty-free licence to display, distribute, and promote that content within the Platform and in marketing materials related to the Platform (e.g., social media highlights, featured athlete showcases). This licence ends when the content is deleted or the Athlete's account is deactivated.

We reserve the right to remove content that violates these Terms and to suspend or terminate the account of repeat offenders.
The Fautor name, logo, design, and software are the property of Davida Online. Nothing in these Terms grants you a right to use our trademarks or branding without prior written permission.
You agree not to:
The Platform is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
We do not warrant that:
To the maximum extent permitted by applicable law, Davida Online and its officers, directors, and employees shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising out of or in connection with your use of the Platform.
Our total aggregate liability for any claim arising from or related to these Terms or the Platform shall not exceed the greater of: (a) the total fees you have paid to Fautor in the 12 months preceding the claim, or (b) EUR 100.
Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud, or any liability that cannot be excluded under applicable law.
You agree to indemnify and hold harmless Davida Online and its officers, directors, and employees from any claims, damages, losses, or expenses (including reasonable legal fees) arising from:
We may suspend or terminate your account, with or without notice, if:
Upon termination: active subscriptions are cancelled, pending payouts are processed where possible, and your access to the Platform ceases. Sections 9 (Content & IP), 11 (Disclaimers), 12 (Limitation of Liability), 13 (Indemnification), and 17 (Governing Law) survive termination.
We reserve the right to modify, suspend, or discontinue any part of the Platform at any time. We will make reasonable efforts to notify users of material changes. If we discontinue the Platform entirely, we will process all pending payouts to Athletes before shutdown.
We may update these Terms from time to time. If we make material changes, we will notify you by email or by posting a prominent notice on the Platform at least 14 days before the changes take effect. Your continued use of the Platform after such changes constitutes acceptance. If you do not agree with the updated Terms, you must stop using the Platform and may cancel your account.
These Terms are governed by and construed in accordance with the laws of the Principality of Liechtenstein, without regard to conflict of law provisions.
In the event of a dispute, the parties agree to first attempt resolution through good-faith negotiation. If no resolution is reached within 30 days, the dispute shall be submitted to the competent courts in Vaduz, Liechtenstein. This does not affect your rights under mandatory consumer protection laws of your country of residence, nor your right to bring proceedings in the courts of your habitual residence if you are a consumer within the EU/EEA.
If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision shall be enforced to the maximum extent permissible, and the remaining provisions shall continue in full force and effect.
